This Privacy Policy (“Privacy Policy”) outlines how GuidingPatients, Inc. and our affiliated companies (“GuidingPatients”, “we,” “our,” or “us”), use Personal Information (defined below) that we process in connection with you use of our website and all software, services, extensions, subdomains, and application programming interfaces (collectively, our “Service”). Any capitalized terms not defined in this Privacy Policy shall have the meaning assigned to them in the User Terms of Service, available here.

We strive to respect privacy and we recognize the need for appropriate protection and management of any Personal Information that is shared with us as part of using our Service. You may also provide Personal Information about another person for whom you may be seeking post-acute care services (“Potential Resident”).

We and our third-party service providers may collect the below categories of Personal Information when you use our Service:

  • Identifiers, such as your name, physical address, email address, and phone number;
  • Employment information, including title and relation to Facility (if applicable);
  • Characteristics of protected classifications under state or federal law, such as age, sex/gender, marital status, medical condition and disability information;
  • Information you provide on our Service for yourself or another person (i.e. a Potential Resident), for example your location, zip/postal code, mailing address, fax number, and email address;
  • Financial information, including the Potential Resident's budget for post-acute care facility options and whether the Potential Resident receives Medicare or Medicaid;
  • Feedback you provide to us about our Service;
  • For Potential Residents, their gender; household income; budget; care needs, including general health information and medical conditions; as well as other information you may choose to voluntarily provide, such as marital status, religion, or ethnicity; and
  • Communications you send to us via any method or channel.

3. When Personal Information is Collected

In connection with our provisions of the Service to you, we may request Personal Information from you. The exact Personal Information that we collect from you may vary depending on the purpose.

For example, we may collect Personal Information via our Service. You may be asked to provide your or the Potential Resident’s name, phone number, physical address, email address, age, zip code, and other similar information.

We have a legitimate interest in using such information to assist in systems administration, information security, abuse prevention, to understand the usage of our Service, to analyze the effectiveness of our Service, and to improve our Service. The information inside the log files includes internet protocol (“IP”) addresses, type of browser, Internet Service Provider, date/time stamp, referring/exit pages, clicked pages and any other information your browser may send to us (collectively, “Log Data”). This Log Data may be used to monitor and analyze use of the Service, technical administration, to enhance functionality and user-friendliness, and to better tailor our Service to your and our other users’ needs. d. Analytics Service. We may use certain third-party analytics services to improve the functionality, features, or delivery of our Service. We may also use these analytics services to record mouse clicks, mouse movements, scrolling activity, as well as any text that you type into our Service. For example, we use Google Analytics on our Service to track user trends and usage. You may choose to not receive future promotional or advertising emails from us by selecting the unsubscribe link at the bottom of each email that you receive from us, and by responding to the emails directly and requesting removal if such a link is unavailable. Additionally, you may send a request specifying your communications preferences to info@guidingpatients.com. Please note that even if you opt out of receiving promotional or advertising emails, you cannot opt out of receiving transactional emails related to the Service.

8. International Users.

Please note that our Service is directed towards users who reside in the United States. By using our Service, you consent to the collection, storage, processing and transfer of Personal Information in and to the United States, or other countries or territories, pursuant to the laws of the United States. While some of these countries may not offer the same level of privacy protection as your own, we commit to uphold the privacy protections as explained in this Privacy Policy.

We reserve the right to retain any Personal Information as long as the Personal Information is needed to (i) fulfill the purposes that are described in Section 5 (The Purposes for Which We Use Personal Information); (ii) comply with applicable law; or (iii) satisfying any legal, regulatory, accounting, or reporting requirements. In some circumstances, we may de-identify, aggregate, or otherwise anonymize your Personal Information consistent with applicable laws and industry standards so that it can no longer be associated with you, in which case it is no longer treated as Personal Information.

The security of Personal Information is important to us. We follow generally accepted industry standards to protect Personal Information that is submitted to us, both during transmission and once we receive it. However, no method of transmission over the internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect Personal Information, we cannot guarantee the absolute security of Personal Information on our Service.

We do not target children and do not knowingly collect any Personal Information from children under the age of thirteen (13). When a user discloses Personal Information on or through our Service, the user is representing to us that they are at least thirteen (13) years of age.

This includes, but is not limited to, information posted to any public areas of the Service, such as forums, blogs, and any ideas for new services or modifications to our Service, and other unsolicited feedback (collectively, “Feedback”). All Feedback shall be deemed to be non-confidential and GuidingPatients shall be free to use, reproduce, disclose, and distribute such Feedback to others without limitation or attribution. You are responsible for the Personal Information you choose to submit in these instances.

13. Your California Privacy Rights.

If you are a California resident, California Civil Code Section 1798.83 permits you to request information regarding the disclosure of Personal Information about you by GuidingPatients to third parties for the third parties’ direct marketing purposes. 14. Changes to This Privacy Policy.

As our organization changes over time, this Privacy Policy is expected to change as well. GuidingPatients reserves the right to amend this Privacy Policy at any time, for any reason, without notice to you, other than the posting of the amended Privacy Policy on our Service. Such changes will be effective immediately upon posting to our Service. By continuing to use or access our Service or by providing us with Personal Information after posting the updated Privacy Policy, you hereby consent to any changes.
